Terms and Conditions of Sale

1. Purpose

These Terms and Conditions of Sale (“T&Cs”) govern the contractual relationship between MAHRA, hereinafter referred to as the “Seller”, and any individual or legal entity, hereinafter referred to as the “Customer”, making a purchase on the website mahraskin.com or any future domain owned by the Seller (hereinafter the “Website”).

Any order placed on the Website implies the Customer’s full and unconditional acceptance of these T&Cs.

3. Products

The Seller markets skincare products. The essential characteristics of each product (composition, size, directions for use, precautions) are described on the corresponding product page.

Product photographs are provided for illustrative purposes only. Slight variations in color or presentation may occur without affecting the conformity of the product.

4. Prices

Prices are displayed in Swiss francs (CHF) for orders from Switzerland, in euros (EUR) for the European Union, in pounds sterling (GBP) for the United Kingdom, and in U.S. dollars (USD) for the rest of the world.

Prices exclude shipping costs. Shipping fees are calculated and displayed to the Customer before final order confirmation.

The Seller reserves the right to modify prices at any time, provided that the price applicable to an order is the one in effect at the time the order is confirmed by the Customer.

5. Orders

Orders on the Website are placed by following these steps: product selection, adding items to the cart, identification, choice of delivery method, choice of payment method, order confirmation, and payment.

The Customer will receive a confirmation email after validating the order, summarizing the products ordered, prices, shipping costs, and delivery address.

The Seller reserves the right to cancel or refuse any order from a Customer with whom there is an existing dispute regarding the payment of a previous order.

6. Payment

Orders must be paid online exclusively by credit card (Visa, Mastercard, American Express), Apple Pay, Google Pay, Shop Pay, or PayPal. Payments are secured through Shopify Payments and Stripe.

The Customer guarantees that they are fully authorized to use the selected payment method when confirming the order.

7. Delivery

Products are shipped through the Seller’s fulfillment partner from warehouses located in North America. Delivery times displayed on the Website are indicative only:

• Switzerland: 5–10 business days
• European Union: 7–14 business days
• United Kingdom & Rest of Europe: 7–14 business days
• International (USA, Canada, Asia-Pacific, etc.): 5–15 business days depending on destination

Customs duties and import taxes, where applicable, are the responsibility of the Customer (DDU – Delivered Duty Unpaid).

In the event of a significant delay, the Customer is invited to contact the Seller at hello@mahraskin.com.

8. Right of Withdrawal

In accordance with European Directive 2011/83/EU and applicable Swiss law, Customers residing in the European Union, the United Kingdom, or Switzerland have the right to withdraw from their purchase within 14 calendar days from receipt of the product.

To exercise this right, the Customer must notify the Seller by email at hello@mahraskin.com before the expiration of the withdrawal period. The product must be returned in its original packaging, unopened and unused, to the address provided by the Seller.

Return shipping costs are borne by the Customer.

Refunds will be processed within a maximum of 14 days after receipt of the returned product, using the same payment method as the original order.

Exclusion: In accordance with applicable regulations, opened or used skincare products (broken hygiene seal) cannot be returned for hygiene and health protection reasons, except in the case of a defective product.

9. Warranties and Product Compliance

All products sold benefit from the legal guarantee of conformity and protection against hidden defects under applicable law.

In the event of a defective or non-compliant product, the Customer is invited to contact the Seller at hello@mahraskin.com within 7 days of receipt, including photographs of the defect. Depending on the situation, the Seller will either replace the product or issue a full refund, including shipping costs.

10. Liability

The Seller shall not be held liable for failure to perform the contract in cases of force majeure, disruption, or total or partial strikes affecting postal services and transportation, as well as floods, fires, or pandemics.

Products are intended for external cosmetic use only. The Seller shall not be held responsible for allergic reactions or intolerances to ingredients listed on the product page; it is the Customer’s responsibility to review ingredients before use.

11. Intellectual Property

All elements of the Website (texts, images, logos, trademarks, and designs) are the exclusive property of the Seller or its partners. Any reproduction, in whole or in part, is strictly prohibited without prior written authorization.

12. Personal Data

The processing of the Customer’s personal data is governed by the Seller’s Privacy Policy, available on the Website.

13. Governing Law and Jurisdiction

These T&Cs are governed by Swiss law. Any dispute relating to their interpretation or execution shall fall under the exclusive jurisdiction of the competent courts in Switzerland, unless mandatory consumer protection provisions provide otherwise.
